Our , as written and ratified by our Founding Fathers, was a risky undertaking at the time as it dared to promise specific inalienable rights for the individual citizen.

They went to great lengths to include built-in safeguards to protect us from any future administrations and any possible misunderstandings or misinterpretations, hence the Bill of Rights was born. The primary part of the Constitution elaborates on what the government may or must do and the Bill of Rights elaborates on what the government may not do. This, in my opinion was pure genius and unprecedented in the annals government.

These documents are the cornerstones of our democracy and, thus far, stood the test of time….for the most part. I say this because of the many laws we now have on the books that legislate the behavior of the individual citizen. For example

• the criminalization of recreational drug use
• sexual practices between consenting adults
• laws governing who we can or  cannot marry
• the right to privacy
• etc., etc……..

The legal doctrine “A man’s home is his castle,” (or et domus sua cuique tutissimum refugium) is reflected in the Bill of Rights: “The right of the people to be secure in their … houses … against unreasonable searches and seizures shall not be violated.” This saying is as old as the basic concepts of English common law and can be traced back to 1581.

I am reasonably sure that research would reveal just where we, as country, began the “slippery slope” resulting in the invasion of our privacy, the legislating of our behaviors and our morality and, in essence, the erosion of those promised “inalienable rights.”

I find it extremely interesting and certainly revealing that the basic tenants of the Libertarian Movement are now considered a radical departure from our current norm and existing laws. The measure of the gap between our present norm and what our Founding Fathers left us with saddens me greatly.

And the thing that really frustrate me is that 90% of the changes mad that added to the erosion described above was made by an individual of group of individuals seeking to fulfill their own agenda. No way in hell were they ever representing the will of the people.

There is not a day that goes by that you cannot read about some intrusion into our individual liberties and the truly tragic thing is that the general public has become so accustom to their “Uncle Sam” dictating who, what, where, and how we choose to live in America.
